Effective Date : 09 August 2026
Last Updated : 09 August 2026

These Terms and Conditions (Terms) govern the registration, access to, and use of the Emas Now Marketplace website, application, and related services (Marketplace).

By creating an account, listing a product, purchasing a product, making payment, selling a product, or otherwise using the Marketplace, the User confirms that they have read, understood, and agreed to these Terms.

1. MARKETPLACE MODEL

Emas Now Marketplace is an electronic marketplace designed to connect buyers and sellers of eligible physical gold, silver, bullion, Logam Mulia, and other approved precious-metal products. Eligible sellers may include:

    • Individuals
    • Retailers
    • Precious-metal dealers
    • Authorized sellers
    • Companies and other approved business entities

Unless specifically identified as a product sold directly by Emas Now, products listed on the Marketplace are offered by independent third-party sellers.

For third-party listings, Emas Now primarily provides the technology, transaction, verification, payment-support, logistics-support, customer-service, and other marketplace infrastructure necessary to facilitate transactions.

Transaction Price means the price accepted by the Buyer at checkout and confirmed by the Marketplace.

Verification means any authenticity, weight, purity, packaging, ownership, identity, or other inspection conducted or arranged by Emas Now.

    • Be at least 18 years old or otherwise legally capable of entering into a binding transaction
    • Provide accurate and complete information
    • Maintain valid contact information
    • Complete required verification procedures

    • Comply with applicable laws and Marketplace policies

Emas Now may refuse registration or restrict access where reasonably necessary for compliance, security, fraud prevention, or Marketplace integrity.

4. USER REGISTRATION

Users may be required to create an account before purchasing or selling Products. Users are responsible for:

    • Maintaining account confidentiality
    • Protecting passwords, PINs, OTPs, and security credentials
    • Ensuring information remains current
    • Preventing unauthorized access
    • Immediately reporting suspected unauthorized activity

Users shall not sell, transfer, rent, or permit unauthorized persons to use their accounts.

5. IDENTITY VERIFICATION — KYC

Depending on transaction value, account type, risk level, or applicable regulatory requirements, Emas Now may request information including:

    • KTP
    • Passport
    • NPWP
    • Photograph or selfie verification
    • Mobile number
    • Email address
    • Residential or business address
    • Bank account information
    • Beneficial ownership information
    • Company incorporation documents
    • Other supporting information reasonably required

Failure to provide requested information may result in transaction delays, restrictions, cancellation, or account suspension where permitted by law.

6. ANTI-FRAUD AND FINANCIAL CRIME COMPLIANCE

Emas Now may implement transaction monitoring and other reasonable measures to detect suspicious or unlawful activity. Where legally required or reasonably necessary, Emas Now may:

    • Request additional documentation
    • Delay transaction processing
    • Restrict an account
    • Reject a transaction
    • Cooperate with competent authorities
    • Take other measures required by applicable law

The Marketplace must not be used for money laundering, terrorist financing, fraud, sanctions evasion, stolen-property transactions, or other unlawful activities.

7. SELLER REGISTRATION

Before listing Products, Sellers may be required to complete additional verification. Business Sellers may be requested to provide:

    • Company registration documents
    • Tax information
    • Authorized representative information
    • Bank account details
    • Business address
    • Beneficial ownership information
    • Other supporting documentation

Approval as a Seller does not constitute an endorsement or guarantee by Emas Now of every Product subsequently listed by that Seller.

8. SELLER PRICING POLICY

Emas Now Marketplace is an open public marketplace where independent Sellers determine the selling prices of their Products. Sellers have discretion to establish their own selling prices, subject to applicable laws and Marketplace policies. A Seller may choose to:

    • Set a fixed Seller Price
    • Reference the prevailing gold or silver market price
    • Set a price above the market reference
    • Set a price below the market reference
    • Apply a premium or discount according to the Seller’s commercial judgment

Prices for identical Products may therefore differ between Sellers.

Factors affecting Seller prices may include:

    • Brand
    • Product year or series
    • Weight
    • Purity
    • Packaging
    • Certificate availability
    • Product condition
    • Rarity
    • Market demand
    • Availability
    • Seller-specific commercial considerations

9. SELLER FIXED PRICE

Where a Seller selects a fixed-price listing, that price shall remain applicable until changed by the Seller or until the Listing expires or is removed. A Seller may modify a Listing before an Order is confirmed. Once an Order is confirmed in accordance with Marketplace procedures, the applicable Transaction Price cannot ordinarily be changed solely because the market price subsequently moves higher or lower.

10. LIVE MARKET PRICE INFORMATION

The Marketplace may display reference prices for gold and silver. Such prices are provided for informational and marketplace functionality purposes and may differ from:

    • Seller prices
    • Retail prices
    • Buyback prices
    • International spot prices
    • Local wholesale prices
    • Prices available through other channels

Temporary delays, data-feed interruptions, exchange-rate movements, or technical issues may affect displayed reference prices.

11. MARKET PRICE FLUCTUATION

Gold and silver prices can fluctuate rapidly. Buyers and Sellers acknowledge that precious-metal values may increase or decrease after a transaction. A subsequent market movement alone does not create an automatic right to:

    • Cancel an Order
    • Demand additional payment
    • Demand a partial refund
    • Change the confirmed Transaction Price
    • Reverse a completed transaction

This clause remains subject to mandatory rights available under applicable law.

12. SELLER RESPONSIBILITIES

Every Seller represents and warrants that:

    • The Seller legally owns or is legally authorized to sell the Product
    • The Product is genuine
    • Product descriptions are accurate
    • Weight and purity information is accurate to the Seller’s knowledge
    • Photographs are not intentionally misleading
    • Material defects are disclosed
    • The Product is not stolen
    • The Product is not counterfeit
    • The Listing complies with applicable laws and Marketplace policies

13. PRODUCT LISTING REQUIREMENTS

Listings may be required to specify:

    • Product name
    • Brand
    • Gold or silver classification
    • Weight
    • Purity
    • Year or series, where relevant
    • Condition
    • Packaging condition
    • Certificate status
    • Quantity
    • Seller price
    • Product photographs
    • Other required information

Emas Now may request corrections or additional information before allowing a Listing to remain active.

14. PROHIBITED PRODUCTS

The following are prohibited:

    • Counterfeit gold or silver
    • Stolen Products
    • Fraudulent certificates
    • Products obtained through unlawful activity
    • Products containing deliberately false purity information
    • Products that Sellers are not legally entitled to sell
    • Other Products prohibited by applicable law or Marketplace policy.

Violations may result in removal, suspension, termination, withholding where legally permitted, or referral to competent authorities where required.

15. BUYER RESPONSIBILITIES

Before confirming an Order, Buyers should carefully review:

    • Seller information
    • Product description
    • Brand
    • Weight
    • Purity
    • Condition
    • Price
    • Applicable Marketplace fees
    • Shipping costs
    • Insurance charges
    • Estimated processing or delivery information

By confirming an Order, the Buyer accepts the Transaction Price displayed at checkout.

16. ORDER PROCESS

A Marketplace transaction may include:

Product Selection → Order Placement → Payment → Payment Verification → Seller Confirmation → Product Verification → Packing → Shipping → Delivery → Transaction Completion

Certain steps may differ depending on the Product, Seller, transaction value, payment method, or delivery method.

17. ORDER CONFIRMATION

Placing an Order does not necessarily mean that the transaction has been finally accepted. An Order may remain subject to:

    • Payment confirmation
    • Seller confirmation
    • Fraud screening
    • Stock availability
    • Product verification
    • Other Marketplace checks

Users will be informed through the Marketplace when an Order reaches the applicable confirmation stage.

18. PAYMENTS

The Marketplace may support approved payment methods including:

  • Bank transfers
  • Virtual accounts
  • Debit or credit cards
  • QRIS
  • Payment gateways
  • Financing or installment providers
  • Other authorized payment methods

Availability depends on the transaction and payment provider. Users must not make payments outside authorized Marketplace channels where the Marketplace requires payment through its official system.

19. PAYMENT SECURITY

Payments may be processed through licensed or approved third-party payment providers. Emas Now may implement fraud-detection measures and may request additional verification before processing high-value or unusual transactions.

20. SELLER SETTLEMENT

Seller proceeds will be processed according to the applicable settlement procedure. Settlement may depend on:

  • Successful payment
  • Product verification
  • Successful delivery
  • Expiry of applicable dispute periods
  • Fraud or compliance checks
  • Other conditions disclosed to the Seller

Applicable Marketplace fees may be deducted before Seller settlement.

21. PRODUCT AUTHENTICITY VERIFICATION

Where applicable, Products may be inspected before delivery or transaction completion. Verification may include:

  • Weight verification
  • Purity testing
  • XRF testing
  • Physical inspection
  • Packaging verification
  • Certificate verification
  • Serial-number verification
  • Other commercially appropriate authentication methods

Verification methods may vary by Product.

22. FAILED VERIFICATION

If a Product fails verification, Emas Now may:

  • Suspend the transaction
  • Request additional information from the Seller
  • Reject the Product
  • Cancel the Order
  • Arrange a refund in accordance with the applicable policy
  • Restrict the Seller’s account in serious cases

Suspected counterfeit or fraudulent Products may be handled in accordance with applicable law.

23. SHIPPING

Products may be delivered through approved logistics providers. Shipping arrangements may vary according to:

  • Product value
  • Weight
  • Destination
  • Insurance availability
  • Security requirements
  • Courier restrictions

Estimated delivery dates are estimates unless expressly guaranteed.

24. SHIPPING INSURANCE

Eligible shipments may receive transit insurance according to the applicable insurance policy. Insurance coverage, exclusions, maximum limits, documentation requirements, and claim procedures are governed by the relevant policy and insurer terms.

25. PACKAGING AND SECURITY

Products may require specialized secure packaging. Users must not deliberately tamper with security packaging, seals, labels, or verification markings for the purpose of making a fraudulent claim.

26. DELIVERY

Delivery may require:

  • Recipient identification
  • OTP
  • Signature
  • Photographic evidence
  • Delivery confirmation
  • Other security verification.

Buyers are responsible for providing complete and accurate delivery information.

27. INSPECTION UPON RECEIPT

Buyers should inspect their packages promptly after delivery. Any apparent discrepancy should be reported within the period specified by the applicable Marketplace dispute or return policy. Users may be requested to preserve:

  • Original packaging
  • Shipping labels
  • Certificates
  • Security seals
  • Photographs
  • Unboxing evidence

28. RETURNS

Because gold and silver are market-priced commodities, ordinary returns may be restricted where legally permitted. Eligible return circumstances may include:

  • Incorrect Product delivered
  • Materially different Product
  • Verified counterfeit Product
  • Incorrect weight or purity
  • Material undisclosed defect
  • Verified transit damage

A change in market price or a Buyer’s change of mind does not automatically create a return right, subject always to mandatory consumer rights.

29. REFUNDS

Approved refunds will be processed according to the original payment method or another legally permitted method. Refund processing time may depend on banks, payment providers, investigations, insurers, and other third parties.

30. BUYER PROTECTION

Cancellation rights depend on the transaction stage and applicable law. Cancellation may be restricted after:

  • Seller acceptance
  • Price confirmation
  • Payment confirmation
  • Product verification
  • Shipment
  • Other irreversible transaction processing

Emas Now may cancel transactions affected by fraud, technical errors, illegal activity, unavailable Products, failed verification, or other legitimate grounds.

35. DISPUTES BETWEEN BUYER AND SELLER
